Terms for a future license agreement

This page describes the terms intended for future KitTrail license sales. Sales are currently closed: these terms are not open for acceptance, the website does not accept payment, and a purchase contract cannot currently be formed through it. Before sales open, the effective version and a working order process will be published.

1. Product and license grant

KitTrail is software for macOS. After sales open and a contract is formed, the Licensor grants the Purchaser a simple (non-exclusive) license to install, launch, and use KitTrail within the purchased plan. Exclusive rights are not transferred. The license has no fixed calendar end date but does not last beyond the term of the exclusive right, unless mandatory law requires otherwise.

2. Plans and prices

The planned licenses are one-time purchases with no subscription:

The plan sets the number of simultaneously activated physical Macs: 1, 2, or 5. Multiple macOS user accounts on one physical computer do not increase the limit. Use on more than 5 Macs requires separate Business/custom terms agreed in writing.

Website language and currency are independent. On first visit, EN defaults to USD and RU to RUB; the user may change currency without changing language. Currency is not selected from IP address, geolocation, VPN, or device region. The selected-currency price and total will be shown before payment. Any conversion by a bank or other financial institution is governed by its terms.

3. One key and shared use

One purchase provides one license and one license key. The Purchaser may let other people use KitTrail by sharing the key, but only on Macs within the plan’s simultaneous-activation limit. The original Purchaser remains the purchasing party, order owner, and person authorized to manage the license, request a refund, and recover access.

Resale of the license or key, rental of activation slots, and systematic redistribution of slots as a commercial pool are not permitted. Ordinary sharing within the purchased plan is allowed.

4. Contract formation, payment, and delivery

After sales open, plan selection, confirmation of agreement to the documents, and the acceptance method will be shown before an order is placed. The intended process is: the Purchaser selects a plan and currency, reviews the total and terms, and then pays through the provider identified on the live payment page. Prodamus is not connected and does not currently accept KitTrail payments.

The contract will be formed after the acceptance specified in the effective Offer and successful payment confirmation by the server-side system. A browser redirect alone does not confirm payment. After confirmation, the license and instructions will be sent to the supplied email address. The delivery timeframe will be published before sales are enabled. The installer is available at /download, but downloading it does not itself provide a license.

5. Activation, support, and recovery

An Internet connection may be required for initial activation. After activation, the application is designed to work without a permanent connection to the licensing server, except for features that objectively require network access. Deactivation releases an activation for another physical Mac within the plan. If the previous Mac is unavailable, the Purchaser may request recovery at hello@getkittrail.com; information confirming the purchase and authority to manage the license may be needed for protection. The exact recovery method and availability depend on the technical state of the service.

6. Updates

All KitTrail updates within major version 1.x are provided to Purchasers at no additional charge, including updates from 1.0 to 1.1, 1.5, and 1.9. Terms for future major versions 2.x, 3.x, and later will be determined separately; free access to every future major version is not promised. The Licensor does not promise a particular update schedule.

7. Withdrawal, refunds, and defects

No additional voluntary unconditional refund guarantee is offered beyond mandatory legal requirements. This does not limit the Purchaser’s mandatory rights.

Rules for withdrawing from a distance transaction, including a seven-day period, apply to the extent the relevant statutory rule applies to the specific software-license agreement. Where a mandatory right of withdrawal applies, the Purchaser may exercise it within the time and procedure required by law. For KitTrail defects, the Purchaser retains the remedies provided by applicable law. Activation alone must not be treated as removing a mandatory right to a refund or another remedy.

Send a request to hello@getkittrail.com with the order identifier and a description of the request. If a refund is confirmed and made on a lawful basis, the corresponding license will end or be placed in a state that prevents further use and activation to the extent permitted by law. A refund does not waive other mandatory rights.

8. Third-party software

A KitTrail license does not include licenses for third-party applications unless expressly stated. Terms, prices, availability, and compatibility of third-party products are determined by their rights holders. The user accepts their terms separately.

9. Personal data

Data processing when using the website, application, licensing service, and support is described in the Privacy Policy. Payment and delivery details are described in Payment & Delivery. KitTrail does not receive or store full payment-card details; the actual payment provider will be identified before payment is enabled.

10. Governing law and mandatory rights

The laws of the Russian Federation apply to the contract to the extent permitted by mandatory rules applicable to the Purchaser. These terms do not exclude or limit mandatory consumer rights in Russia or another jurisdiction where those rights apply.

11. License termination and changes

A license may end on grounds provided by law and the concluded contract, including a confirmed full refund. Future-purchase terms may change; a new version applies only to purchases made after it takes effect and does not reduce rights already granted, except where required by law.
